International Commercial Arbitration

The practice of commercial arbitration in Hispanic America, its benefits, opportunities and challenges for companies and their legal advisors in the pursuit of justice.

Certification course lasting 108 hours, including 72 hours of webinar sessions and 36 work sessions on the virtual platform.

Objetive:

Arbitration has taken on increased importance in Latin America as a tool for settling disputes. This certification course focuses on arbitration in the region, with the aim of connecting practitioners, providing feedback and improving practice. We start with a network of professors (from Chile, Mexico, Colombia, Spain, Switzerland, Peru, the USA, among others), and teach the key elements of arbitration using a pragmatic approach. This is an opportunity to offer high-quality formation to Spanish-speaking lawyers who wish to improve or start up their own arbitration practice. The course serves to establish links between professionals from different regions, including arbitrators, attorneys, academics, corporate lawyers and others interested in the topic. Each guest professor schedules his or her synchronous session. In the asynchronous sessions, participants work on practical exercises.

Lawyers from different areas, including litigators, company lawyers, corporate officers, notaries, government officials, academics, among others.

  • Overview and the ABCs of contracts (CISG and UNIDROIT)
  • The arbitration agreement
  • Laws applying to arbitration
  • Jurisdiction of the court of arbitration and organization of the proceedings
  • Establishment and organization of the court of arbitration
  • Development, submission and review of evidence in hearings
  • Claims, counterclaims and defense
  • Formulation of written communications and of the arbitration award
  • Damage claims and their assessment
  • The role of national courts in arbitration proceedings
  • Appealing, acknowledging and executing arbitration awards
  • Investor-state arbitration
  • Rules of the Stockholm Chamber of Commerce in Sweden (SCC)
  • Rules of the International Chamber of Commerce (ICC) in Paris
  • Swiss SCAI (Swiss Chambers' Arbitration Institution) rules in Switzerland
  • Arbitration and mediation center of the World Intellectual Property Organization
  • Rules of the Arbitration Center of Mexico (CAM, in its initials in Spanish)
  • Rules of the CAM Santiago de Chile
  • Rules of AMCHAM Peru
  • Rules of the Arbitration and Conciliation Center of Bogotá.
  • Commercial arbitration between states (OMC)
  • Sports arbitration
